What a valid takedown notice must include
To be effective under 17 U.S.C. § 512(c)(3), your written notice must include all of the following:
- Identification of the copyrighted work you claim has been infringed (or a representative list, if multiple works).
- Identification of the material you claim is infringing, with enough detail (such as a URL) for us to locate it.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
Incomplete notices may delay our response. Knowingly submitting a material misrepresentation may expose you to liability for damages under 17 U.S.C. § 512(f).
How we respond
On receipt of a compliant notice we will act expeditiously to remove or disable access to the identified material, notify the user who posted it, and forward a copy of the notice. We keep a record of every notice, our action, and the date.
Counter-notice procedure
If you believe your material was removed by mistake or misidentification, you may send a counter-notice to our agent containing: your physical or electronic signature; identification of the removed material and its location before removal; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; and your name, address, telephone number, and consent to the jurisdiction of the federal district court for your address (or, if outside the United States, the Northern District of Illinois), and that you will accept service of process from the person who filed the notice.
We will forward your counter-notice to the original complainant. Unless they notify us that they have filed a court action seeking to restrain the activity, we may restore the material in 10 to 14 business days.
Repeat infringer policy
We maintain a repeat-infringer policy. Accounts that are the subject of repeated valid infringement notices, or that we determine are engaged in infringing activity, may be suspended or terminated at our discretion, without refund where permitted by our Terms of Service.
